Diese Bedingungen gelten für die Nutzung des Spiels und aller darin angebotenen Online-Funktionen. Mit der Installation und Nutzung erkennst du sie an.
Du erhältst ein einfaches, nicht ausschließliches, nicht übertragbares Recht, das Spiel auf deinen Geräten für private Zwecke zu nutzen. Nicht gestattet sind insbesondere:

Das Spiel ist im Solo-Modus vollständig ohne Konto nutzbar. Für Online-Funktionen (Koop, PvP-Duelle, Online-Bestenlisten, Freundesliste, geräteübergreifende Sicherung) ist ein kostenloses Konto erforderlich.
Käufe im Spiel werden über den jeweiligen App-Store abgewickelt (Google Play, später Apple App Store).
Beim Kauf digitaler Inhalte, die sofort bereitgestellt werden, erlischt das Widerrufsrecht, sobald mit der Ausführung begonnen wurde und du dem ausdrücklich zugestimmt und deine Kenntnis vom Erlöschen bestätigt hast. Diese Zustimmung holt der App-Store im Kaufvorgang ein; die Belehrung erfolgt dort. Soweit im Einzelfall dennoch ein Widerrufsrecht gegenüber dem Anbieter besteht, genügt eine formlose Erklärung an info@mythos-defense.com.
Das Spiel ist ab 13 Jahren freigegeben. Bist du minderjährig, darfst du Käufe nur mit Einwilligung deiner Eltern oder Erziehungsberechtigten tätigen. Wir richten keine Kaufaufforderungen gezielt an Kinder und verwenden keine Gestaltungen, die zum Kauf drängen. Eltern können Käufe in den Einstellungen des App-Stores sperren oder mit einer Passwortabfrage schützen.
Öffentlich sichtbar sind selbst gewählte Spielernamen (Bestenlisten, Mehrspieler-Lobby, Duell-Aufzeichnungen). Du sicherst zu, keine Namen zu verwenden, die Rechte Dritter verletzen oder beleidigend, diskriminierend, jugendgefährdend oder werblich sind.
Mit der Nutzung räumst du dem Anbieter das Recht ein, deinen Spielernamen und deine Spielergebnisse im Rahmen der Spielfunktionen anzuzeigen. Anstößige Namen lassen sich im Spiel melden (Fähnchen ⚑ am Eintrag) oder per E-Mail; jede Meldung wird innerhalb von 72 Stunden geprüft.
Der Anbieter haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper und Gesundheit und nach dem Produkthaftungsgesetz. Bei einfacher Fahrlässigkeit haftet er nur bei Verletzung einer wesentlichen Vertragspflicht (einer Pflicht, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung du regelmäßig vertrauen darfst), begrenzt auf den vertragstypischen, vorhersehbaren Schaden. Im Übrigen ist die Haftung ausgeschlossen. Eine Änderung der Beweislast zu deinem Nachteil ist damit nicht verbunden.
Wir können diese Bedingungen ändern, wenn dies zur Anpassung an geänderte Rechtslage oder an neue Spielfunktionen erforderlich ist. Über wesentliche Änderungen informieren wir im Spiel oder auf mythos-defense.com. Widersprichst du nicht innerhalb von 30 Tagen oder nutzt das Spiel weiter, gelten die geänderten Bedingungen als angenommen; auf diese Wirkung weisen wir in der Mitteilung gesondert hin.
Es gilt deutsches Recht. Bist du Verbraucher mit gewöhnlichem Aufenthalt in einem anderen EU-Staat, bleiben die zwingenden Verbraucherschutzvorschriften deines Aufenthaltsstaates unberührt.
Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung bereit: ec.europa.eu/consumers/odr. Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
Sollte eine Bestimmung unwirksam sein, bleibt die Wirksamkeit der übrigen unberührt.

The game Mythos Defense: Magnara is provided by Marcel Gickel, Schwarzwaldstraße 15, 76597 Loffenau, Germany (info@mythos-defense.com, see legal notice). These terms apply to the game and all of its online features. By installing and using the game you accept them.
You receive a simple, non-exclusive, non-transferable right to use the game on your devices for private purposes. You may not sell, rent or commercially exploit the game, modify, decompile or reverse engineer it beyond what the law expressly permits, use cheats or bots, or overload the servers. All rights in the game, its graphics, texts and music remain with the provider or the respective rights holders.
Solo play works entirely without an account. Online features (co-op, PvP duels, online leaderboards, friends list, cross-device sync) require a free account. Keep your password secret and do not share your account. Accounts are personal and must not be traded. You can delete your account inside the game (Profile → Account → Delete account) or by e-mail, see account deletion. We may suspend or delete an account for serious or repeated breaches of these terms; except in severe cases we will warn you first.
Virtual items are not property and not a means of payment. You receive a right of use limited to the operating life of the game. They cannot be exchanged back into real money, paid out, transferred or sold to other players. Everything can also be earned by playing – purchases are a shortcut, not an advantage that is otherwise unavailable. We may adjust balance, in-game prices and earning rates; content you have already unlocked stays yours.
Purchases are processed by the respective app store (Google Play, later the Apple App Store). Your contracting partner for the purchase and payment is the app store operator, not the provider; their terms, payment and refund policies apply. We receive no payment data, only confirmation that a purchase was completed. All prices are final prices in your store account's currency and include statutory VAT; the price is shown before the purchase in the game and again in the store's order dialogue. Refunds follow the app store's rules – please contact them first. You may also always write to info@mythos-defense.com; in case of technical faults we will help without red tape.
For digital content supplied immediately, the right of withdrawal expires once performance has begun and you have expressly consented and acknowledged that you lose that right. The app store obtains this consent during the purchase and provides the corresponding notice. If a right of withdrawal towards the provider nevertheless exists in an individual case, an informal message to info@mythos-defense.com is sufficient.
The game is rated 13+. If you are a minor you may only make purchases with the consent of your parents or legal guardians. We do not direct purchase prompts at children and do not use designs that pressure players into buying. Parents can block purchases or require a password in the app store settings.
Self-chosen player names are publicly visible (leaderboards, multiplayer lobby, duel recordings). You undertake not to use names that infringe third-party rights or are offensive, discriminatory, harmful to minors or promotional. You grant the provider the right to display your player name and results within the game's features. Offensive names can be reported inside the game (flag ⚑ next to the entry) or by e-mail; every report is reviewed within 72 hours.
Solo play works offline permanently. For online features we operate a server; we cannot guarantee uninterrupted availability (maintenance, faults, force majeure). The game continues to be developed, so content, features and balance may change. Should online operation be discontinued permanently, we will announce this at least 30 days in advance in the game and on mythos-defense.com. Solo play remains available. For paid content not yet consumed at that point we will seek an appropriate solution; statutory rights remain unaffected.
The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence liability exists only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded. This does not involve any change to the burden of proof to your detriment.
We may amend these terms where necessary to adapt to changes in the law or to new game features. We will announce material changes in the game or on mythos-defense.com. If you do not object within 30 days or continue to use the game, the amended terms are deemed accepted; we will point this out separately in the notice.
German law applies. If you are a consumer habitually resident in another EU member state, the mandatory consumer protection provisions of your state of residence remain unaffected. The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration body. Should any provision be invalid, the remainder stays in force.
